A WORD ABOUT DEED RESTRICTION VIOLATIONS

 FROM THE KPCA BOARD


In the fall we hired Kingwood Association Management (KAM) to ride through our community once a month and inform us of deed restriction violations.  As a volunteer board, we were unable to enforce the deed restrictions in a consistent, uniform manner.  Consequently, some homeowners have received letters informing them of violations that may not have been noticed previously.  Some other violations may be new.  The purpose of our letter(s) informing homeowners of violations is to request the correction of the violation and to keep our community up to the standards of our Protective Covenants.


If you receive a letter and do not agree with the finding, PLEASE do not just throw the letter away.  Contact someone at KAM at 281-359-1102 to discuss the situation.  If you need to discuss it further, call a board member.  If the situation is just ignored, you will receive another letter by certified mail.  This obviously means more expenditure by the CA.  If the second letter is ignored, the next step is to turn the matter over to our attorney.  At this point legal costs will be the responsibility of the homeowner.


The cost of these last two steps can be avoided if you are responsive to the first letter, either by correcting the violation or speaking with someone at KAM to resolve the situation.  This is especially important if more time is needed to correct the violation.
