A.  PROGRAM FOR ARCHITECTURAL CONTROL

1. Mission Statement for Architectural Control

• To review and evaluate for approval those applications for improvements to homes, structures and properties within Kings Point Community Association, as defined by The Landing, The Cove, The Pointe, and Willow Pointe, in accordance with the By Laws and Protective Covenants.
  
• To ensure such improvements are of suitable quality and harmonious within the community, as well as, considerate of neighbors.
  
• To enforce compliance regarding uses and conditions of resident’s properties as set forth in Protective Covenants.
  

2. Architectural Control Guidelines

• Guidelines have been established by the Architectural Control Committee (ACC) and have been reviewed and approved by the Kings Point Community Association Board of Directors (Board).

• KPCA guidelines cannot conflict nor usurp requirements or codes of the city of Houston.
  
• Guidelines provide fair and uniform information for all Kings Point residents (homeowners and renters) regarding:
  
• Quality of materials, harmony of external design, size, and relative location of improvements.
  
• Conformance of improvements and property uses with the Protective Covenants
  
• The ACC reviews/approves all matters concerning improvements and conformances as set forth in these guidelines.
  
• Association members may appeal decisions by the ACC to the Board, whose decision will be final.
  
• Guidelines will be maintained by the ACC and may be updated from time to time after review and approval by the Board. Notices of these updates will be given via the Kings Point Village newsletter, website or special notice to residents.

3. Kings Point Community Association (“KPCA”) and Its Governances

• KPCA was established by Friendswood with membership consisting of all homeowners.
• Regular election of Board of Directors as set forth in the KPCA “By Laws.”

• KPCA Board appoints the Architectural Control Committee members as set forth by these guidelines.

4. Friendswood and Architectural Control of Kings Point Village

• Friendswood is the developer of Kingwood who established “Protective Covenants.”

• Protective Covenants establish architectural controls for property improvements and uses.

• Friendswood assigned rights for architectural control to an Architectural Control Committee who is appointed by the Board of Directors of KPCA.

B. THE APPLICATION AND APPROVAL PROCESS

• Items Requiring/Not-Requiring Prior Approval.

• Prior approval is required for all additions, improvements or changes to residents’ real property , including color changes.

• The following items do not require approval: However, should any of these actions result in the application of unsuitable materials or workmanship which is judged by the ACC to detract from the community, the ACC has the right to require they be replaced.

- Repaint house/garage the same color.

- Re-roof house/garage with the same roofing material.

- Repair house/garage with the same type of exterior materials.

- Installation of landscaping.

- Installation of birdbath, birdhouses, benches, tables or statuary   must follow guidelines herein.

 - Installation of basketball goals must follow guidelines herein.

 - Installation of lighting must follow guidelines herein.

• Application Process

• Plans and specifications for improvements are to be submitted in writing for approval in advance. No consideration will be given in those instances when post-construction approval is requested.

• Plans and specifications should include:

1. The nature of the change or addition.
2. Specifications and plans.
3. Measurements (height, width, depth, elevation, etc.)
4. Materials to be used.
5. Color
6. Location on the property in relation to other structures.
7. Harmony of design.
8. Location in relation to topography.
9. Location of utility easements.
10. Signature of owner(s).
11. Additional information as requested by the ACC or the Board.

            12. Under no circumstances can community property be used to access construction site; must go thru owners driveway/property.

• The ACC has thirty (30) days from the date of receipt of a complete proposal to respond, after which if there has been no response the application is deemed to be accepted. The ACC will endeavor to respond in a timely manner to facilitate a resident’s planning and implementation process.
   
• Tentative approval of applications may be given verbally by the ACC Chairman or its designee followed by written verification.

• Any KPCA resident has the right to appeal a decision of the ACC to the KPCA Board of Directors, whose decision shall be final and binding.

• Variances

• The Board of Directors, upon recommendation of the ACC, is empowered to grant variances to the Protective Covenants for a resident whose proposed improvements vary from the Protective Covenants.
• All costs associated with the preparation and recording of a variance shall be the responsibility of the resident.

C. DEFINING THE “BUILDING ENVELOPE”

• Building setbacks are measured from a property line to the foundation edge of  the subject building. Eaves, steps and unroofed terraces may extend beyond the setback lines, but may not encroach on another property. See Figures C-1, 2 and 3 on the following pages for orientation to the allowable building envelope.

2. Building Setback lines from:

• Front Street: Front Building Line is typically set back sixty (60) feet from the front property line or street curb. For specific setback, refer to individual lot plan/survey or section/subdivision plat.

• Side or Rear Street: Setback for Main Building is ten (10) feet to any side or rear Street right-of-way line.

• Interior Lot Line: Setback for Main Building is ten (10) feet from an Interior Lot Line; whereas the setback for a garage or secondary improvement is a minimum seven (7) feet.

• Easements Provide Access Through/To a Property for a Public Utility, and for Drainage.

• Typically, an eight (8) foot utility easement, but in some cases sixteen (16) foot, extends in from the rear property line for all utilities. A three (3) foot drainage easement extends in from each side property line. Refer to individual lot plat/survey for specific dimensions.
  
• No building improvement (including pool decking) or addition to an existing building can be erected on easement.

• Driveways, walkways and fences can cross easements.

• Neither Friendswood nor any utility company using an easement are liable for any damage to any improvement on land covered by an easement. However, they will likely attempt to restore flower beds and fences the way that they found them.

• Height Guidelines

• Main Building: Not to exceed two (2) stories. Additions should generally conform to the existing rooflines of the Main Building.

• Garage: Not to exceed the height of the Main Building. Additions should generally conform to the existing rooflines of the garage and Main Building.

• Gazebos\pavilions\cabanas\Outdoor kitchens: Peak of structure roof should be limited to twelve (12) feet in height from the ground.  However, depending upon the size of the structure, higher roofs may be acceptable but must be justified by contractor/owner.  Flat gazebo roofs shall not exceed (10) feet in the height above the ground.

• Children’s Play Structures: The maximum height is ten (10) feet from the ground. (Note: Structures above  ten (10) feet require a variance from the Protective Covenants.)

• Fences: No wall or fence , planter or hedge in excess of two (2) feet in height shall be erected or maintained nearer to the front lot line than the front building setback line. No side or rear fence or wall shall be more than six (6) feet high plus a 6 inch rot board.  No fence shall be of wire or chain link construction. No fence shall be constructed on lots adjoining the greenbelt without prior written approval. See additional restrictions for lake lots under (H.) fences.
